01Definitions and Legal Framework

Booking any service offered by DASPE TRAVEL E.I.R.L. through its physical platforms or its websites, including https://daspetravel.com, is governed by these Terms and Conditions. The Customer and the Agency expressly submit to these clauses.

• THE AGENCY: DASPE TRAVEL E.I.R.L. (Tax ID / RUC 20601588219), a local travel agency and tour operator registered in Cusco, Peru. The Agency acts as a direct operator for excursions and as an organized intermediary for third-party services such as hotels, railways and airlines.
• THE CUSTOMER: the individual or legal entity purchasing any service. Where minors are involved, parents or legal guardians assume full responsibility for all acts and expenses incurred.
• THE SERVICE: the logistical and operational organization of tours, including transportation, accommodation, meals, entrance tickets, guiding and other related items detailed in the itinerary.

Tacit acceptance: making the 50% booking deposit payment constitutes immediate, total and irrevocable acceptance of these terms, and serves as a binding electronic signature.

02Booking, Payments and Deadlines

• Booking and management deposit (50%): to guarantee and confirm any service, the Agency must receive an advance payment of 50% of the total cost.
• Outstanding balance (remaining 50%): you may pay the balance at any time before arrival. The mandatory deadline is 48 hours before the tour starts, so that payment can be verified in our accounts.
• Failure to pay: if payment is not verified within that deadline, the Agency reserves the right to cancel the reservation for breach of contract, and the initial deposit is forfeited with no right to a refund.
• Transaction fees: all fees derived from the payment method, including banks, PayPal, Visa, Mastercard and Western Union, are covered in full by the Customer.

The 50% deposit is 100% NON-REFUNDABLE and NON-TRANSFERABLE. It is used immediately for administrative management and to purchase nominal assets such as Machu Picchu tickets, train tickets and Inca Trail permits, which under Peruvian law cannot be refunded.

03Third-Party Rate Increases and Currency Fluctuations

Tour prices are based on the tariffs, government taxes, operational costs and exchange rates current at the time of quotation. The Agency reserves the right to adjust the final price in order to maintain the economic equilibrium of the contract in the following cases:

• Sudden, unforeseeable rate or tax increases by direct third-party providers, including but not limited to train operators, bus companies, entrance fees to archaeological sites, and hotel rates.
• Significant fluctuation in the exchange rate of the US Dollar against the Peruvian Sol. Local operational expenses are paid in PEN, so a devaluation of the USD reduces the real purchasing power allocated to the tour. If the exchange rate drops by more than 3% between the booking date and the final balance payment date, the Agency reserves the right to recalculate the remaining balance to cover the currency deficit.

The Agency notifies you promptly with the corresponding mathematical justification, and the Customer agrees to cover this verified difference in the final payment.

04Cancellation Policy and Asset Delivery

• Cancellation by the Customer: if you cancel after having paid 100% of the tour, no cash refund will be provided.
• Asset delivery: in place of a cash refund, the Agency fulfils its responsibility by delivering the entrance tickets, train tickets and other vouchers that strictly correspond to the confirmed and paid reservation, issued in the passenger's name.
• Operational release: once those assets are delivered, the Agency is released from all operational responsibility, including guide services, private transportation and meals, which are non-refundable because they have already been booked and accrued.
• No show: failing to arrive at the scheduled time, or lacking original documents such as a passport or ID, results in the loss of 100% of the service value with no right to a refund.

05Force Majeure and Contingency Protocols

Force majeure means unpredictable and unavoidable events such as earthquakes, floods, landslides, extreme weather, strikes, roadblocks, rail closures, civil unrest, or government shutdowns of archaeological sites.

• Ticket management: if the Peruvian Government or the train companies formally authorize date changes due to the contingency, the Agency will handle that process for you.
• Limitation of liability: if the authorities do not authorize a change, the Agency is not obliged to provide new tickets. New tickets must be paid for by the Customer if you wish to reschedule.
• Extra expenses: the Agency does not assume costs for additional hotel nights or flight changes resulting from force majeure.

06Machu Picchu, Huayna Picchu and Student Discounts

• Volatility of availability: special tickets such as Huayna Picchu or Machu Picchu Mountain have limited capacity and are not guaranteed until physically issued.
• Student discount: requires a copy of a valid university ID sent at the time of booking, and presentation of the original physical card at the entrance control. Without the original physical card the ticket is forfeited, with no liability to the Agency.

07Physical Condition, Health and Acclimatization

• Acclimatization: we strongly recommend arriving in Cusco 48 to 72 hours before starting high-effort activities. The Agency is not responsible for altitude sickness or related health complications.
• Authority during the trip: the Agency reserves the right to remove from a tour any person who puts their own integrity, or that of the group, at risk through lack of physical capacity or inappropriate conduct, with no right to a refund.

08Service Standards and Accommodation

• Regional categorization: the Customer accepts that service standards in Peru may differ from those in their home country. Local homestays are rustic and form part of the cultural experience.
• Third parties: trains and buses to Machu Picchu are operated by external companies and are subject to their own terms and conditions.

09Travel Insurance, Assistance and Emergencies

• Insurance: the Agency considers it highly recommended to purchase comprehensive travel insurance that includes coverage for adventure tourism and rescue.
• Commitment to assistance: our staff is trained in first aid and coordinates with health services. We provide logistical support such as a first aid kit and coordination of local evacuation in the event of an emergency.
• Limits of assistance: this support is subject to the geographical, weather and social limitations of the region. The Agency does not guarantee response times for external government services.

Financial exoneration: the Agency does not assume the financial cost of emergencies, including clinics, hospitalization or repatriation. Those expenses must be covered by the Customer or their insurance provider.

10Privacy, Image Rights and Jurisdiction

• Chargeback waiver: the Customer agrees not to initiate chargeback processes with their bank in respect of the initial deposit, acknowledging that this amount has already been executed for non-refundable purchases made in their name.
• Image rights: the Agency may use audiovisual material captured during the tour for marketing purposes, unless expressly prohibited in writing.
• Jurisdiction: any legal dispute is submitted exclusively to the courts of the city of Cusco, Peru, under Peruvian legislation.

11Modification of Terms and Validity

The Agency reserves the right to update or modify these Terms and Conditions at any time in order to optimize operations or adapt to new legal frameworks.

For each specific booking, the terms in effect on the exact date the 50% booking deposit was confirmed are the ones that apply. Subsequent modifications do not affect bookings already paid, unless such changes are mandatory under provisions issued by the Peruvian Government.
